Terms of Service

Effective date: March 1, 2026

These Terms of Service ("Terms") govern your access to and use of the Yak mobile application and related services (the "Service") operated by Bear Logic LLC ("Yak," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Nature of the Service

Yak is a software platform that provides informational content, mapping tools, route data, GPX files, and progress tracking related to outdoor recreation, including hiking, climbing, mountaineering, skiing, and backcountry travel. Yak is not a guide service, outfitter, rescue provider, safety authority, emergency service, or professional advisor. The Service is provided for informational and tracking purposes only.

2. Assumption of Risk

Outdoor activities involve inherent and unpredictable risks, including serious injury, permanent disability, property damage, and death. Certain objectives listed within the Service may involve extreme environments, high altitude, remote terrain, severe weather, avalanche danger, rockfall, navigation errors, equipment failure, wildlife hazards, and other life-threatening conditions.

By using the Service, you knowingly and voluntarily assume all risks associated with your activities. You acknowledge that you are solely responsible for your preparation, decisions, route verification, equipment, and safety. The Service is not designed or intended for use in emergency situations.

3. No Warranties

The Service and all content are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Yak disclaims all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement. Yak does not warrant that the Service will be uninterrupted, secure, or error-free, or that any information provided is complete, current, or accurate. Electronic devices, connectivity, and GPS signals may fail.

The Service is not a substitute for proper training, independent navigation, or professional instruction.

4. User Responsibility

You are solely responsible for verifying route conditions, land access, permit requirements, and applicable regulations before undertaking any activity. You are responsible for carrying appropriate equipment and backup navigation methods and for possessing the necessary skills and experience. Yak does not monitor real-time environmental conditions and does not provide emergency, rescue, or safety services.

5. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

6. Intellectual Property

The Service and its content, excluding user-submitted content, are owned by Bear Logic LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any portion of the Service without prior written permission.

7. User Content

If you submit content to the Service, including photos, notes, or route information, you grant Yak a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and improving the Service. You represent that you have the rights necessary to submit such content.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Bear Logic LLC and its owners, officers, employees, affiliates, contractors, and contributors shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including personal injury, death, property damage, emotional distress, loss of data, or economic loss, arising out of or related to your use of or inability to use the Service.

If liability cannot be fully excluded, it shall be limited to the greater of one hundred U.S. dollars (USD $100) or the amount paid by you to Yak in the twelve months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Bear Logic LLC from and against any claims, damages, liabilities, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service or violation of these Terms.

10. Dispute Resolution and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration under the Federal Arbitration Act and conducted in Colorado. You and Yak agree to waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
